Contributor Terms & Conditions

Preamble

These Contributor Terms & Conditions (“Contributor Terms”) outline the agreement between you, the Contributor, and Lawpret.com (“Lawpret”), which encompasses its owners, directors, authorized employees, and assigns; regarding the submission of literary, artistic, and statistical works (“Work”) for publication and use under Indian law.

Intellectual Property

  1. Ownership: The Contributor retains copyright ownership of the Work.
  2. License Grant: The Contributor grants Lawpret a non-exclusive, perpetual, and irrevocable license to use, modify, publish, and distribute the Work globally.
  3. Moral Rights: The Contributor agrees to waive the enforcement of moral rights to the Work to allow Lawpret to use the Work without attribution and to modify it as necessary.

Contributor Representations and Warranties

  1. Originality: The Contributor asserts that the Work is their original creation and has not been copied from any other source.
  2. Non-Infringement: The Contributor assures that the Work does not infringe upon any third-party rights and complies with all applicable laws.
  3. Prior Non-Publication: The Work has not been previously published or disclosed in any form.
  4. Disclosure: The Contributor has disclosed any previous agreements that may conflict with this agreement.

Use of Work

  1. First Publication: Lawpret has the right of first publication for the Work.
  2. Editing: Lawpret reserves the right to edit the Work to fit its content standards and format, future updates, corrections, etc.

Confidentiality

  1. Non-Disclosure: The Contributor agrees to keep Lawpret’s proprietary information, including the terms of this agreement, confidential.

Compensation

  1. Fee: If applicable, compensation for the Work will be mutually agreed upon and documented in writing.

Legal and Compliance

  1. Indemnification: The Contributor will indemnify Lawpret against any legal claims resulting from the Work’s publication.
  2. Dispute Resolution: Any disputes will first be subject to arbitration / mediation, with jurisdiction in Bengaluru, India.

General Provisions

  1. Amendment: These Contributor Terms may be revised by Lawpret from time to time. Upon publication of the revised Contributor Terms at this webpage, the revised Contributor Terms will be applicable.
  2. Severability: If any provision is unenforceable, the remaining provisions remain in effect.
  3. Entire Terms: These Contributor Terms represent the full agreement between the Contributor and Lawpret.
  4. Notice: All notices must be in writing and delivered to the respective emails.
  5. Assignment: The Contributor may not assign this agreement without written consent from Lawpret.
  6. Waiver: No waiver of any term is deemed a further or continuing waiver of such term or any other term.

Acceptance

By submitting any Work to Lawpret, the Contributor agrees to these Contributor Terms in full.

Jurisdiction

These Contributor Terms are governed by the laws of India and subject to the exclusive jurisdiction of the courts in Bengaluru.
